Consequences for an Oklahoma drug possession conviction are compounded when the charge includes intent to sell or intent to distribute. Drug distribution penalties include two years to life in prison.Other circumstantial evidence which may be used to prosecute an intent to sell or intent to distribute case includes possession or presence of drug paraphernalia such as scales, baggies, and lab equipment; large sums of cash; packing materials; guns and ammunition; and cell phone messages or text messages. This evidence may only be obtained through a legal search, granted by a valid search warrant, just cause, or the consent of the person to be searched or the owner of the property to be searched. Most defense attorneys will scrutinize the manner in which any evidence was obtained. If evidence was gathered illegally, it will become inadmissible, and the case could be dismissed.

While there is no set amount of drugs necessary for a charge of intent to sell or intent to distribute, large quantities can lead to a drug trafficking charge.

The difference between intent to distribute and trafficking lies mainly in the amount of contraband found. There are minimum amounts necessary for an Oklahoma trafficking conviction. For example, if one were found to be in possession of twenty-five pounds of marijuana, twenty grams of meth, or five grams of crack cocaine, he or she would be charged with trafficking rather than simply possession or even possession with intent to distribute.
